Opening a Labour File in Dubai

Two registrations stand between a new licence and a first employee. Companies do one of them, assume they are finished, and stall at the work permit.

What is a labour file and why does a company need one?

It is your company registration with the employment authority, and it is what allows work permits to be issued for the people you hire. It sits alongside the establishment card, which handles residence sponsorship on the immigration side. A company needs both: one to permit the work, the other to sponsor the residence.

Two files, two jobs

The distinction confuses nearly every new employer, and it is simple once said plainly. The labour file governs the right to work. The immigration file governs the right to reside. An employee needs both, so a company needs both.

Opening one and stopping is how a first hire ends up three weeks late.

  • Labour file: the right to work
  • Immigration file and card: the right to reside
  • Employees need both, so employers do
  • Neither substitutes for the other

Quota, and how many people you can actually hire

Opening the file is not the same as being approved for unlimited staff. A quota governs how many permits you can file, and it is assessed against your activity, your premises and the size of your operation.

Ask for what you will realistically need this year, not what you might need in five.

  • Quota governs how many permits you can file
  • Assessed against activity and premises
  • Office size can constrain it
  • Set it against a realistic hiring plan

Premises matter more than owners expect

A flexi-desk and a full office are not treated the same way when quota is assessed. Companies that bought the cheapest desk package and then planned to hire six people find the two do not meet.

If hiring is the plan, factor it into the premises decision rather than discovering the ceiling afterwards.

  • Premises type affects quota
  • Flexi-desk packages carry lower ceilings
  • Ejari or lease has to match the licence
  • Plan premises around hiring, not the reverse

Then the ongoing obligations start

Once the file is live you are an employer with the duties that come with it: registered contracts, salary payment through the wage protection system, and renewals that arrive on their own schedule.

It is worth knowing the shape of that before the first hire rather than after the first penalty.

  • Employment contracts registered properly
  • Salaries paid through the wage protection system
  • Permits and the file renewed on schedule
  • Records kept for each employee

Which file does what

Registration and purpose
RegistrationGoverns
Labour fileThe right to work; work permits
Establishment cardThe right to reside; residence visas
Quota approvalHow many staff you may file for
WPS registrationHow salaries are paid
Trade licenceOperating the business itself
The mistake we see most: Choosing the cheapest premises package while planning to build a team. Quota is assessed partly on premises, and companies discover the ceiling after they have hired, when moving office is the only fix.
MSM tip: Open the labour file and the establishment card in the same week, even if your first hire is months away. They are assessed on the same underlying documents, so doing them together is barely more work than doing one.

What documents do you need?

What we need

Trade licence and licensing authority
Company documents as issued
Tenancy contract or Ejari for the premises
Owner or manager passport and Emirates ID
Your realistic hiring plan for the year
Whether you are mainland or in a free zone

Give us the hiring plan honestly. Quota set too low means going back for more; set against a fantasy it invites questions you would rather not answer.

QUESTIONS & ANSWERS

Frequently Asked Questions

What is the difference between the labour file and the establishment card?
The labour file governs the right to work and issues work permits. The establishment card governs residence sponsorship. An employee needs both, so the company needs both.
Can I open one and not the other?
You can, and you will stall at the first hire. They are opened together because they are assessed on the same documents.
How many employees can I sponsor?
That is set by quota, assessed against your activity and your premises. Tell us your hiring plan and we will apply accordingly.
Does my office size matter?
Yes, more than most owners expect. A flexi-desk package carries a lower ceiling than a full office, and it is hard to fix after you have hired.
What comes after the file is open?
Quota approval, then work permits, then residence visas. WPS registration follows so salaries can be paid compliantly.
Is it different in a free zone?
Yes, and it varies between zones. Tell us the zone by name so we can tell you what your package already covers.

Ready to hire your first employee?
