Terms of Service
Last updated: June 10, 2026. These Terms govern all services provided by MSM Document Clearing Services in the UAE.
Welcome to MSM Document Clearing Services. By engaging our services, accessing our website, or requesting consultations, you agree to be bound by these Terms of Service. Please read them carefully. If you do not agree, you must not proceed with contracting our services.
1. Service Scope and Facilitation
MSM Document Clearing Services acts as a professional intermediary and typing facilitator. We assist clients in navigating UAE corporate setup structures, preparing documentation, performing government typings (Amer, Tasheel, DHA, ICP), translating files legally, and clearing folders with governmental ministries. We are a private agency and are not affiliated with or a part of any UAE government ministry or department.
2. Client Obligations and Accuracy of Data
To perform document clearing, you must supply all necessary papers in a timely, complete, and fully authentic manner. By submitting files to us, you warrant that:
- All documents provided (passports, IDs, educational certificates, company files) are genuine, legally obtained, and un-tampered.
- All information supplied in applications is accurate.
- You possess the legal authority to submit such records.
Strict Warning: Under UAE Penal Code, presenting forged or falsified documents to a government authority is a severe criminal offense. MSM assumes zero liability for verifying the authenticity of client-provided documents. In the event that a government authority flag documents as fraudulent or invalid, the client bears full civil and criminal responsibility, and MSM will immediately terminate services without a refund.
3. Government Fees and Payment Terms
Our billing consists of two components: our service/typing fees and government regulatory fees.
- Government Fees: Government tariffs (DED name registration, visa fees, medical screening charges, labor deposits) are determined solely by the respective UAE authorities and can change without notice. The client must pay all government fees in advance in full. MSM will not advance government fees on behalf of the client.
- MSM Service Fees: Our fees are charged as agreed upon contract signing or case initiation. Service fees are non-refundable once typing has begun or documents have been submitted to government portals.
- Additional Expenses: Costs such as translations, attestations, or delivery logistics are billed separately unless explicitly packaged.
4. Government Timelines and Rejections
While we coordinate files efficiently and seek to minimize processing delays, the client explicitly acknowledges that:
- The approval, rejection, delay, or amendment of any application (trade license, residency visa, work permit, health card) is at the **sole discretion** of the respective UAE government departments (e.g., ICP, MoHRE, DET, DHA, Dubai Police).
- Government processing times fluctuate due to system maintenance, security vetting, public holidays, or regulatory changes. MSM does not guarantee fixed turnaround times.
- MSM is not liable for rejections based on security checks, nationality restrictions, profession eligibility, or DED activity rules.
5. Fines, Overstay, and Penalties
The client is responsible for maintaining their legal status in the UAE. MSM will not be held liable for immigration overstay fines, DED late renewal penalties, labor contract fines, or medical card delay fines, unless such fines are caused directly by proven gross negligence or document misplacement by MSM's staff. It is the client's responsibility to supply requested records before immigration grace periods expire.
6. Cancellation and Refunds
If you wish to cancel an active application, you must notify us immediately in writing. Refund eligibility depends on the stage of processing:
- If the application has not been typed or initiated, a refund of service fees may be issued minus administrative processing fees.
- If government vouchers have been generated or portal typing has occurred, government fees allocated are governed by government refund policies (which are typically non-refundable or subject to government deductions), and MSM service fees are fully non-refundable.
7. Governing Law and Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates. Any dispute, claim, or controversy arising out of or in connection with our services shall be subject to the exclusive jurisdiction of the competent courts of the Emirate of Dubai, United Arab Emirates.
8. Updates to Terms
MSM reserves the right to modify these Terms of Service at any time to reflect updates in UAE regulations or service adjustments. Continued engagement of MSM services following any updates constitutes acceptance of the revised terms.
